COVID -19 Economic Relief Plan (CERP) Reporting on MCIX Agreement

Parties

 

This document constitutes an agreement (Agreement) between 

Myanmar Microfinance Association (MMFA), registered at Room #008 (Ground Floor), Building C1, Sa-bai Street, Sinmalite Yuzana Highway Complex, Kamayut Township, Yangon, Myanmar
and
ThitsaWorks Solutions Myanmar Co., Ltd. (Technical Provider), a company incorporated in Myanmar under company registration number 115275984 having its registered office at Sky View Tower, No. 28 (A) Kyauk Kone Street,  Room#701, Yankin Township, Yangon 11081, Myanmar
and

Microfinance Institution (MFI), a Microfinance Institution participating in the CERP program.

Subscription Fee

Subscription fee for CERP reporting on MCIX is $250 annually as per proposal  by Technical Provider. This fee is covered in full by MMFA.

Objectives

The mission of MCIX is to share and exchange basic credit information of micro-borrowers among Members of MCIX to manage credit risks and to gain financial intelligence while protecting the micro-borrowers from becoming over-indebted. Information sharing that allows for the control and monitoring of multiple, overlapping loans while protecting the privacy of clients is in the interest of MFIs, clients, and the overall financial sector. While the financial sector in Myanmar develops, and in anticipation of tools like credit bureaus, this protocol provides simple measures for MFIs to share data in a responsible manner. Our Services are designed to help our members by enabling you and other members to access to CERP micro-borrowers and make decisions efficiently in a trusted environment.

Agreement

MFIs joining MCIX solely for CERP Reporting will have access to selected features limited to CERP Reporting and not the full Enterprise version of MCIX. This Agreement between the parties as may be amended from time to time in accordance with the provisions relating to any such amendments.

 

Term of Use

1. MFI agrees to:

  • Provide access to current employees for the intended objectives only.

  • Be responsible for MCIX user accounts. MFI agrees to: (1) choose a strong and secure password; (2) keep password secure and confidential; (3) not transfer any part of account to anyone; (4) each user must have his/her own credentials. MFI is responsible for anything that happens through your account unless you close it or report misuse.

  • Submit all data that will allow for the control and monitoring of client over-indebtedness. MFI agrees that the information you provide is accurate, truthful, and complete.

  • Keep your contact information up to date so we may provide notices to you in the following ways: (1) a banner notice on the Service; or (2) an email sent to an address you provided; or (3) through other means including mobile number, telephone, or mail. 

  • Be responsible for the manner and purpose in which MCIX is used. MFI shall not use the MCIX in a manner that violates Myanmar or other applicable law, or that causes a nuisance or disruption of the service to other customers of MCIX.

  • Acknowledge that “Interest” column in MCIX means “Interest plus fees”.

  • Acknowledge that “Township, Ward, Village, Ward/Village Name” in MCIX are for business (teashops/ restaurants).

 

​2. Technical Provider shall

  • Use all reasonable care in the compilation of the information which forms any part of the Services. However, the responsibility of the accuracy of information submitted by users rests with the submitting user. By using MCIX, MFI may encounter information that might be inaccurate, incomplete, delayed, or misleading. The information and data is provided on an “AS IS” and “AS AVAILABLE” basis.

  • Not be responsible for Users’ information or data or for any damages as a result of your use of or reliance on it.

  • Reserve the right to terminate access for an institution that is not submitting complete data accurately monthly or any violation of agreement set forth.Reserve the right to grant government authority access to information if it is demanded by the authorities.
